These terms and conditions govern your use of fairywrenembroidery.com and any purchase of products, classes, or commissions made through this website or our linked online shop. By using this site or placing an order, you agree to these terms.

Who we are

Fairy Wren Embroidery is a sole trader business operated by Emma Broughton, based in Amesbury, Wiltshire, UK.

Changes to this website and these terms

 

We may update or remove parts of this website at any time. We may also update these terms and conditions from time to time, for example to reflect changes in the law or in how we operate. The current version will always be available on this page, and continued use of the site after changes are posted means you accept the updated terms.

Placing an order

 

When you place an order, you confirm that:

  1. You are legally able to enter into a binding contract (i.e. not a minor).

  2. The personal details you provide are complete and accurate.

  3. You are not using a false name or someone else's identity without authorisation.

 

A contract between you and us comes into existence once we have processed and dispatched your order, or, in the case of classes and commissions, once we have confirmed your booking.

Products and goods

 

We sell embroidery kits, supplies, and related products via our online shop. We aim to describe products accurately, but slight variations in colour, texture, or finish may occur, particularly with handmade or hand-dyed materials.

Geographic availability: We currently sell goods within the UK and to selected international destinations. We do not sell or ship goods to customers in the European Union or Northern Ireland, in line with our obligations under the EU General Product Safety Regulation (GPSR). Under the Windsor Framework, Northern Ireland follows EU product safety rules for goods, so the same restrictions apply.

Classes, tuition, and commissions

 

In addition to physical products, we offer in-person and online embroidery tuition, courses, and bespoke commissions.

  • Bookings for classes are confirmed once payment has been received and you have received a booking confirmation from us.

  • Course materials provided as part of a class or course are for your personal use only and may not be reproduced, resold, or redistributed without our written permission.

  • Commissions are bespoke and may require a deposit. Specific terms (timescales, pricing, cancellation) will be agreed with you individually in writing before work begins, and those terms take precedence over this general policy where there is any conflict.

  • Cancellations by you for class bookings should be made as far in advance as possible; refund eligibility depends on how much notice is given and is set out at the time of booking.

  • Cancellations or rescheduling by us (for example due to insufficient numbers or unforeseen circumstances) will be notified to you as soon as possible, and you will be offered a full refund or an alternative date.

Cancelling a product order

 

You may cancel a product order at any time before dispatch, except for personalised or commissioned items, and will receive a full refund to your original payment method.

If you are a UK consumer, you also have a statutory right to cancel most online orders within 14 days of receiving them, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, even after dispatch. This right does not apply to personalised or bespoke items made to your specification.

Cancelling after dispatch: if you cancel after your order has been dispatched, this is treated as a return and is subject to our Returns policy below, including responsibility for return postage costs.

Made-to-order kits: some of our kits are made up after you place your order rather than held as ready stock. Being made to order does not, on its own, make a kit "personalised" — the 14-day cancellation right and our Returns policy still apply to these kits in the same way as any other standard product. A kit only counts as personalised, and therefore exempt from cancellation and return, where it has been customised specifically for you (for example, a bespoke colourway, monogram, or size made to your individual specification).

Order confirmation

 

Once you place an order, you will receive a confirmation email containing the order details, including items ordered and price paid.

Delivery

 

You may choose from the delivery options offered at checkout. Estimated delivery times are not guaranteed. We are not responsible for delays caused by circumstances outside our reasonable control (for example, postal service disruption), but we will do our best to keep you informed.

Returns

 

We accept returns within 14 days of delivery, provided the item is unused, unwashed, and returned in its original packaging and in resaleable condition.

  • Please contact us before sending anything back, so we can confirm the return and provide instructions.

  • We recommend using a tracked service for returns.

  • You are responsible for return postage costs, unless the item is faulty or was not as described.

  • Once we receive the returned item, we will process your refund (excluding original shipping costs) or exchange as agreed.

  • Where you are exercising your statutory 14-day right to cancel under the Consumer Contracts Regulations 2013, standard delivery costs paid at checkout will also be refunded.

  • Personalised items and bespoke commissions cannot be returned, except where faulty.

This is in addition to, and does not affect, your other statutory rights as a consumer.

Your statutory rights

Nothing in these terms affects your statutory rights as a consumer. In particular, if you are a UK consumer, your purchases are protected under:

  • The Consumer Rights Act 2015 — which gives you rights to goods that are of satisfactory quality, fit for purpose, and as described

  • The Consumer Contracts Regulations 2013 — which gives you cancellation rights for most online purchases

Liability

We make reasonable efforts to keep the information on this website accurate and up to date, but we do not guarantee its accuracy and accept no liability for errors or omissions, to the extent permitted by law.

We are not responsible for any loss or damage to your own devices or systems arising from your use of this website, and you are responsible for ensuring your own equipment is adequately protected (e.g. against viruses).

Nothing in these terms excludes or limits our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, or for fraud.

Intellectual property

 

All content on this website, including text, images, designs, patterns, and course materials, is owned by Fairy Wren Embroidery / Emma Broughton unless otherwise stated, and may not be reproduced, distributed, or used commercially without our prior written permission.

Pricing, duties, and tariffs

 

All prices are shown in pounds sterling (GBP) and include VAT where applicable.

US customers: A surcharge is applied to all orders shipping to the United States to cover current import tariff and handling charges. This surcharge is calculated at checkout and is designed to cover all duties and fees payable on import, so there should be no additional costs on delivery. We review this surcharge regularly and will adjust it if tariff rates change.

All other international customers: You are responsible for any import duties, taxes, or customs charges applicable in your country. We are not responsible for delays caused by customs processing.

Governing law

 

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, without affecting any mandatory consumer protections that may apply in your country of residence.

Severance

 

If any part of these terms is found to be invalid, unlawful, or unenforceable, that part will be removed and the remaining terms will continue to apply in full.
